When Work Wears You Down: Axis Legal Is Fighting for Wisconsin’s Injured Workers

Featured on The Morning Blend

For many Wisconsin workers, the aches and pains that come with decades of work feel like an inevitable price for a well-lived life. Contractors who have swung hammers for 30 years, nurses who have lifted patients throughout their careers, roofers, mechanics, and warehouse workers – people who have given everything for their profession and assume that a tired body is simply a part of the job.

Alex Eichorn, managing attorney at Axis Legal, LLC, wants those workers to think again.

The Legal Standard Is Lower Than You Think

“I talk to a lot of people who say, ‘I knew what I was doing to my body,'” Eichorn said during a recent appearance on The Morning Blend. “But the legal standard doesn’t look at it that way.”

Under Wisconsin workers’ compensation laws, a worker does not need a single dramatic accident to have a valid claim. Instead, it is the material contribution of the work to the injury that matters – and this standard is lower than many people realize. Eichorn explains this using an analogy that resonates with his clients: a drop of water on a stone. A single drop does nothing, but after 30 years of drops there is a hole through the stone.

“If your shoulder MRI at 52 looks like it belongs to an 80-year-old,” Eichorn explained, “the doctor is going to ask what you did for work – and that’s your claim.”

What Is a Loss of Earning Capacity Claim?

These are called loss of earnings claims. They exist for workers who are forced into early retirement or career changes due to their bodies not being able to keep up anymore. Many people never pursue these claims because they weren’t aware that they could.
